Legal provisions regarding the import / export of unaccompanied baggage

Laws and regulations

Bringing goods into the Republic of Moldova

Individuals are entitled to receive goods sent as international post consignments or unaccompanied baggage, provided that the goods are for their personal use and are not intended for commercial or production activity, as well as provided that import duties are paid.

Unaccompanied baggage - goods sent by the owner (possessor) or at his/her request, which are taken across the customs border by the carrier and are not accompanied by the owner (possessor).

Goods for personal use are any items intended for personal use or consumption, or household needs, including personal clothing and footwear, bed linen, equipment for personal use or for household needs, perfumery, cosmetics, toiletry, medicines, food for personal consumption, goods intended for family use, pets, as well as portable instruments the person needs to perform the trade or profession, all these goods not being intended for the commercial or production activity;

Goods categorized as goods for personal use (clothing, footwear, perfumery, cosmetics, toiletry and medicines, as well as food) are goods purchased (obtained) for use (consumption) by the person crossing the customs border or by members of his or her family, as provided in paragraph (3) of Article 11 of the Law. The existence of family members is confirmed by relevant documents. In the absence of these documents, the goods cannot be qualified as goods for personal use. Individuals may be granted tax facilities upon importing goods specified above, pursuant to the provisions of letter b) paragraph (1) of Article 5 or the annex to the same Law.

When the unaccompanied baggage enters the territory of the country, import duties shall be charged (except for the cases provided for in letter d) paragraph (1) of Article 5 of the Law), based on general principles, provided that they are not intended for commercial or production purposes and that they are declared as required.

Unaccompanied baggage, intended for commercial or production activity, can only be brought into the country by economic operators registered with the SE "State Registration Chamber" as subjects of entrepreneurial activity.

The goods qualify as unaccompanied baggage based on a document issued by the owner (consignor) of the goods or a proof of conclusion of the transport contract.

Individuals are allowed to bring goods into the territory of the country or to receive, by means of international post consignments or unaccompanied baggage, goods free of import duties, provided that they are not intended for commercial or production activity, in connection with the establishment of permanent residence in the Republic of Moldova or by obtaining these goods by inheritance. The fact of establishing the permanent place of residence or obtaining the inheritance is confirmed by related documents. The manner of granting the relief is established by the Customs Service.

In connection with the establishment of a permanent place of residence in the Republic of Moldova for the import of goods subject to relief from import duties, the following documents shall be submitted to the customs authority:

a) confirmation of repatriation or permanent residence permit issued by the Office of Migration and Asylum of the Ministry of Internal Affairs of the Republic of Moldova;

b) the list of personal effects to be taken into the country, signed by the individual in question.

 Declaration procedure

-  the carrier shall present the list of packages to the border customs authority (item 11 of the GD);

- the packages must be sealed in such a way that access to their contents is impossible without breaking the seal or leaving visible traces (item 51 of the GD);

- the goods brought into and taken out the territory of the Republic of Moldova by means of unaccompanied baggage shall be declared in writing, in the established manner (Article 4 of the Law and item 14 of the Order);

- when removing goods (including unaccompanied baggage) from the customs territory of the Republic of Moldova, individuals may submit the customs declaration both to the customs authority in the country (during business hours) and to the border customs authorities (item 14 of the Order);

- the customs control of unaccompanied baggage is carried out only in the presence of a legally authorized representative of the baggage holder. The representative of the holder of the unaccompanied baggage can be any individual with full legal capacity and who has a document confirming his/her right to represent this baggage (item 26 of the Order).

Customs control

Customs control of unaccompanied baggage is carried out in the presence of a legally authorized representative of the baggage holder. Taking the baggage over the customs border without the legal representative of the holder is not allowed.

The representative of the holder of the unaccompanied baggage can be any individual with full legal capacity and who has a document confirming the right to represent this baggage.

 Taking goods out of the Republic of Moldova

Individuals are entitled to take out of the territory of the Republic of Moldova the following:

    1. goods, irrespective of their value (including those sent as international postal consignments or unaccompanied baggage), without payment of any export duties, provided that they are declared according to relevant regulations and are not intended for commercial or production activity;
    2. goods (including those sent as international postal consignments or unaccompanied baggage) intended for commercial or production activity, the customs value of which does not exceed the amount of 100,000 euro, provided that economic policy measures are observed, with payment of export duties and declaration of goods as laid down in relevant regulations
